Partition Proceedings

Real Property & Partition Mediation

Partition proceedings, easements, and boundary disputes present challenges that extend beyond traditional litigation. These matters often involve inherited property among siblings or extended family with emotionally charged dynamics alongside the legal and financial complexity of shared and/or disputed ownership.

As an attorney with experience in real property disputes, Colleen brings an understanding of North Carolina partition law under Chapter 46A. As a mediator, Colleen is known for her affinity for spreadsheets as she facilitates the parties’ negotiations around credits for contributions and carrying costs and/or buyouts.

Partition and boundary disputes are among the matters that a Clerk may refer to mediation. The Rules Implementing Mediation in Matters Before the Clerk of Superior Court were enacted pursuant to N.C. Gen. Stat. § 7A-38.3B to provide a framework for matters referred to mediation by the Clerks of Superior Court.

In addition to being certified to mediate Superior Court matters, Colleen is also certified by the NC Dispute Resolution Commission to mediate Clerk of Court, Special Proceedings, Estates & Guardianship.
